Terms of Service

These Terms of Service ("Terms") are an agreement between you and Raygio LLC, a California limited liability company ("we," "us," "our"), governing your use of the WhereIsX mobile app and the whereisx.app website (together, "WhereIsX").

By using WhereIsX, you agree to these Terms. If you do not agree, do not use the service.

Eligibility

You must be at least 13 years old to use WhereIsX. If you are between 13 and 18 (or the age of majority in your jurisdiction), you represent that a parent or legal guardian has reviewed these Terms.

Your account

• You are responsible for keeping your sign-in credentials secure.
• You agree to provide accurate information when signing up.
• You may not share your account with others. (You can invite household members through the in-app sharing features instead.)
• We may suspend or terminate accounts that violate these Terms, with or without notice.

Acceptable use

When using WhereIsX, you agree not to:

• Use the service for unlawful purposes
• Upload or store content that violates someone else's rights, including intellectual property, privacy, or publicity rights
• Attempt to reverse-engineer, decompile, or interfere with the service
• Probe, scan, or test the vulnerability of any system or network connected to the service without our prior written consent
• Use automated means to access the service in ways that disrupt other users or violate our rate limits
• Resell, sublicense, or commercially exploit the service without our prior written consent

Your content

You own the items, descriptions, photos, and other content you save in WhereIsX ("Your Content"). By using the service, you grant us a limited, non-exclusive, royalty-free license to host, process, transmit, and display Your Content solely to operate the service for you.

We do not claim ownership of Your Content. We do not use Your Content to train artificial intelligence models, ours or anyone else's.

AI features

WhereIsX uses Google's Gemini API to transcribe your voice and to understand what you ask it. AI responses are best-effort and may be inaccurate, incomplete, or unexpected. Do not rely on WhereIsX for safety-critical decisions (e.g., locating medication in an emergency).

Subscriptions

WhereIsX may offer paid subscription tiers ("WhereIsX Pro").

• Pricing and billing terms are shown in the App Store or Google Play before you subscribe.
• Subscriptions auto-renew until you cancel them through the App Store or Google Play settings — we do not have the ability to cancel for you.
• All payments are processed by Apple or Google. Refund requests must be made through the platform that processed the payment (Apple's policies apply for App Store purchases; Google's apply for Play Store purchases).
• We do not issue refunds directly.
• If a payment fails, your subscription may be paused or canceled per Apple's or Google's billing-retry policies.

Intellectual property

WhereIsX (the app, website, brand, logos, and code) is owned by Raygio LLC and protected by intellectual property laws. We grant you a personal, limited, non-transferable, non-exclusive license to use the service in accordance with these Terms. Nothing in these Terms transfers ownership of the service to you.

Service availability

We strive to keep WhereIsX available and reliable, but we do not guarantee uninterrupted access. The service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We may modify, suspend, or discontinue any part of the service at any time, with or without notice.

Limitation of liability

To the maximum extent allowed by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim arising from your use of WhereIsX is limited to the greater of (a) the amount you paid us for the service in the 12 months before the claim arose, or (b) US$50.

Some jurisdictions do not allow these limits, in which case the limits apply to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold us harmless from any claim or demand made by a third party arising from Your Content, your violation of these Terms, or your violation of any law or third-party right.

Termination

You can stop using WhereIsX and delete your account at any time, in the app's Settings.

We may terminate or suspend your account if you violate these Terms or for any reason at our discretion. On termination, your right to use the service ends immediately. Provisions of these Terms that by their nature should survive termination (e.g., intellectual property, limitation of liability, indemnification) will survive.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any disputes arising from these Terms or your use of WhereIsX shall be resolved exclusively in the state or federal courts located in Sacramento County, California, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. The "Effective date" at the top will reflect the latest version. For material changes, we'll notify you in the app before the changes take effect. Continued use of the service after the effective date of an updated version constitutes your acceptance of the new Terms.
